Types of Alimony in Tennessee

Alimony, also referred to as spousal support in other states, describes one spouse’s obligation to support the other spouse.

Tennessee has four types of alimony:

  • Alimony in futuro: This type is common in longer marriages and allows the spouse to maintain a similar standard of living as that during the marriage.
  • Transitional alimony: This type is designed to help an economically disadvantaged spouse adjust to life with the expenses of the divorce.
  • Rehabilitative alimony: This type is designed to help the spouse return to school or take other steps to become self-supporting after a divorce.
  • Alimony in solido: This type of alimony is a lump sum paid to the other spouse over time to compensate for imbalanced property division.

Whether alimony may be modified after the divorce and when the alimony obligation will cease is all determined by what type of alimony is prescribed in your situation.

How Long Do You Have to Be Married to Receive Alimony?

Typically, in a marriage that lasted under 10 years, the spouse will be awarded a rehabilitative alimony to help them become financially independent of the other spouse. In marriages lasting longer, alimony is determined based on the needs of the supported spouse.
